Joe The Plumber Snooper Gets Paid Leave

DBKP reported before, and perhaps initially, that Helen Jones-Kelley violated both State and Federal Regulations when she ordered staff to conduct an investigative sweep of Joe The Plumber using the Child Support investigative computers. These computers have more access than any other in government, being able to review files for taxes, property records, traffic, crime, prison, drivers license, court, and on and on. The reason given is that the need is imperative and the use is non-criminal.

Hence no warrant needed.

It now appears that despite the cover given her by the despicable and corrupt Governor Strickland, that the Attorney General--who in fact administers the Child Support collection efforts and knows the law well, or at least assigned staff who does--has put together enough of a case to commence disciplinary proceedings.

Jones-Kelley put on paid leave by governor

As the Dayton Daily News reports:

"COLUMBUS — Helen Jones-Kelley, director of the Ohio Department of Job and Family Services and former head of that department in Montgomery County, has been placed on paid administrative leave by Gov. Ted Strickland.

Charles already was investigating reports that a department computer was used to gather personal information about "Joe the Plumber" — Samuel Joseph Wurzelbacher of suburban Toledo — after Wurzelbacher emerged as a key figure in the presidential race in Ohio. The information included whether he owed child support, which he said he didn't.

He criticized Democrat Barack Obama's tax plan and endorsed Republican John McCain.

Charles is investigating whether such use of a state computer is legal. Jones-Kelley said there was nothing wrong with the check and suggested it was common practice for her department to do research on Ohioans in the news.

Well, it sure took them long enough, didn’t it?

An Ohio Highway Patrol trooper was stationed at the end of Jones-Kelley's driveway in Clayton on Friday night. He declined to allow a reporter to approach Jones-Kelley's home.

Strickland, a Democrat, has said that so far he had received no information to suggest that any state employee either accessed or disclosed information in an inappropriate or improper way."

Sure.

That is why the entire country knows that Joe the Plumber does not owe Child Support, etc.

The TRUTH is this: Strickland did not ask Charles to investigate. Charles did so on his own after being informed by his staff that such information such as the child support and court status of Joe the Plumber, as was leaked to the media, had to involve the illegal usage of a Ohio State Child Support Investigative computer.

A simple check matching the security entry codes (issued to each child support investigator) with a search relative to Joe the Plumber quickly revealed the investigator who accessed his files, all files by the way. A security review of the investigator, usually conducted by Bureau head, quickly produced the fact ther investigator was ordered to do the review by Helen Jones-Kelley under the fallacious excuse that Joe had requested information on his file.

It was also revealed that the investigator had no idea who Samuel "Joe the Plumber" Joseph Wurzelbacher was. The given name was unfamiliar to her. Even though Jones-Kelley is not entitled to the information as she is not in the need-to-know loop, it is likely the investigator thought she was merely passing on good news to someone.



Ms Jones-Kelley must be fired. As a law enforcement official, she has totally compromised her position and the trust of the public. She should be charged with both State and Federal crimes. (of course, we all know that Bush only prosecutes Republicans)

As for Strickland, he waited until after the election because Charles was running for office. No doubt hoping it would blow over if Charles lost.

Unfortunately for Strickland, Charles did not let go.

As for that guard at the door, he is there to make sure the press do not learn it was Governor Strickland who asked Helen Jones-Kelley to commence the computer sweep.

That is my guess.

It is now being discovered that the Ohio government checks into the records of Joe the Plumber were quite extensive. There are now four separate focal points of the investigation; among them, a low-level law enforcement computer operator--now relieved of duty--and the director of the Ohio Department of Job and Family Services, Helen Jones-Kelley.

This latter usage is far more troubling.

Not only because the job is a political appointment and the hold very likely knew better, but also because of a little-known quirk in the laws of search and seizure.

As reported in The Columbia Dispatch:

The checks were run after the news media reported that Wurzelbacher was considering buying a plumbing business with more than $250,000 in annual income, Jones-Kelley wrote.

"Given our understanding that Mr. Wurzelbacher had publicly indicated that he had the means to purchase a substantial business enterprise, ODJFS, consistent with past departmental practice, checked confidential databases ,...

"Not surprisingly, when a person behind in child support payments or receiving public assistance is receiving significant media attention which suggests that the person appears to have available financial resources, the Department risks justifiable criticism if it fails to take note and respond," Jones-Kelley wrote."

That, of course, is absolute nonsense.

How would anyone know if such a person owed child support? And an inquiry into the so-called past practices would reveal that no such 'practice' existed. The Federal and State guidelines for Child Support investigative sweeps require that there be a specific target first.

In other words, the agency must first know that Joe owes or owed child support.

It is unheard-of that such a sweep would occur at the cabinet level; normally the results of such investigations are not shared with individuals outside of the Child Support Directors office--pending legal action.

In fact this says much about the banana republic that Ohio is transforming itself into. In most States this would be a scandal of momentous occasion.

What is so special about the use of Child Suppport investigative techniques?

They are unique. Without any warrant, and unlike any other government entity, including the taxing authorities, Child Support has the ability to access all government computers: taxes, even Federal by arrangement, law enforcement, prison, labor, traffic, voter registration--you name it.

All government data bases are available to Child Support. In fact, Child Support can physically examine tax returns and applications of various sorts. So the rules of usage are very strict and the penalties normally severe.

But apparently not in Ohio.

The information was made public. We know Joe owed some property taxes. We know he does not owe child support. We also know that Ms Jones-Kelley searched his tax and criminal records.

This was relevant to child support, how?

Ayers traded in his bombs for a grant writer's pen. Ayers hit the jackpot when he hired a young lawyer to administer his Chicago Annenberg Challenge.

That young lawyer's name was Barack Obama.

Big Media won't talk about Obama's many ties to socialism and communism--Ayers wrote in "Prairie Fire" that his movement was unabashedly "communist.

References to early Obama associations have been scrubbed from the Internet.

Obama's still refused to release his college and university records and a media which was hot for George Bush's college records and John McCain's medical records, has maintained a lockstep silence over the lack of the same records from Barack Obama.

A John Edwards-esqe cone of silence by the Mainstream Media on these records. The MSM is/has been intent on apologizing, explaining away, whitewashing and comforting voters who may have misgivings over the many questionable relationships and alliances Barack Obama has chosen over the years.

Alliances which shed light on Barack Obama.

Another story that is not getting much ink these days concerns the one bill that Barack Obama has proposed in the U.S. Senate--along with Chuck Hagel and Maria Cantwell: the Global Poverty Act.

The bill was the subject of a strong editorial in Investor's Business Daily of February 28, 2008, "Obama's 0.7% Solution For Poverty Gets Pass from Senate Republicans." According to IBD, the bipartisan bill would require the president "to develop and implement a comprehensive strategy to further the U.S. foreign policy objective of promoting the reduction of global poverty, the elimination of extreme global poverty and the achievement of the Millennium Development Goal of reducing by one-half the proportion of people worldwide between 1990 and 2015, who live on less than $1 per day."

The "Millennium Development Goal" refers to a United Nations declaration adopted by the U.N. Millennium Assembly and Summit in 2000 that calls for "the eradication of poverty" by "redistribution (of) wealth and land," cancellation of "the debts of developing countries" and "a fair distribution of the earth's resources." The IBD reports that "The Millennium project is monitored by Jeffrey D. Sachs, a Columbia University economist. In 2005 he presented then-U.N. secretary general Kofi Annan with a 3,000-page report based on the research of 265 so-called poverty specialists. "Sachs' document criticized the U.S. for giving only $16.5 billion a year in global anti-poverty aid. He argued that we should spend an additional $30 billion a year in order to reach the 0.7% target that the U.N. set for the U.S. in 2000....Sachs said that the only way to force the U.S. to commit that much money is by a global tax, such as a tax on fossil fuels [oil, coal, natural gas]." The tax would be imposed not only on their production, but on their use, as well. Among other consequences, Americans would be impoverished for the purpose of reducing poverty abroad by 0.7 percent of the U.S.'s gross domestic product.

Barack Obama's record in the U.S. Senate is that he is the most liberal member of that legislative body.

Quite an achievement for a relatively new member of the Senate; a man who "had only been in the Senate 143 days before announcing for president."

Obama's signature piece of legislation in the U.S. Senate is the proposed Global Poverty Act. The Global Poverty Act would transfer almost a trillion dollars from the United States to poor people the world over.

It's stated goal: to cut world poverty in half by 2015--using billions of U.S. taxpayers' money.

The Global Poverty Act of 2007 also had Republican backers; they will bear responsibility for their support.

But only one of the bill's backers is running for president: Barack Obama.

If the Global Poverty Act becomes law--it's already passed the Democrat House--Barack Obama will certainly "spread the [U.S. taxpayers'] wealth around".

It will take from the U.S. taxpayers--Joe the Plumber, Suzy the Homemaker, Phil the Bricklayer, Terry the Teacher and all the rest--and give it to countries around the world.

It will then be up to these countries, many run by dictators who are to blame for their people's lack of wealth, to spread the U.S. taxpayers' wealth around. Wealth that was earned in our capitalist system will be transferred to many who live under systems which are antagonistic to capitalism and wealth creation.

Good luck with all that.

The Obama campaign says that calling Barack Obama a "socialist" is a failed tactic, reserved for the evil troika of Fox News, the Drudge Report and the McCain campaign.

What is the intent of the Obama's Global Poverty Act?

It's part of a socialist vision that penalizes wealth creation, takes from those who earn and gives it to those who don't.
